These terms are a contract between you and Ranmont Ltd (“Ranmont”, “we”, “us”), the company behind Nightjar. They cover two things: the licence to use the Nightjar app and its map packs (our end-user licence agreement, or “EULA”), and the rules for using our website and waitlist. Please read them. By downloading, unlocking, or using Nightjar, or by using our website, you agree to them.
Nothing here takes away rights the law gives you as a consumer. Where UK or your local consumer law gives you a stronger right than these terms, that stronger right wins.
The full terms below are what actually governs. This summary is just a friendly map.
Nightjar is built and sold by Ranmont Ltd, a company registered in England & Wales.
We are the licensor of the Nightjar software and map packs. Depending on how you bought Nightjar, the seller of your purchase may be our Merchant of Record rather than us. See section 4.

Nightjar is intended for people who can form a legally binding contract. By buying or using it you confirm you are at least 18, or the age of majority where you live, and that you have the legal capacity to agree to these terms. Nightjar is not directed at children.
Nightjar runs on macOS on Apple Silicon. It’s your responsibility to check the current system requirements on our website before you buy. A fault that comes only from running Nightjar on hardware or an OS it doesn’t support isn’t something we can be responsible for.
We sell Nightjar through a third-party Merchant of Record (“MoR”), Lemon Squeezy (Lemon Squeezy, LLC). This is normal for small software companies and it matters to who you’re contracting with:
So the MoR sells you the licence as our authorised reseller; we grant and stand behind the licence. Where the MoR’s buyer terms and these terms both speak to a payment, tax, or checkout question, the MoR’s terms govern that transaction. For everything about using the software, these terms govern.
We may change our MoR, add other resellers, or sell directly in future. If we sell to you directly, references to “the MoR” simply fall away and Ranmont is your seller as well as your licensor; the rest of these terms are unaffected.
When your purchase is complete you receive a licence key (an “entitlement”). It’s a bearer key: whoever holds it can unlock the corresponding features, so keep it private, like a password. There are no user accounts, so the key is your proof of purchase. Store it somewhere safe.
Subject to these terms and to your having paid, Ranmont grants you a personal, worldwide, non-exclusive, non-transferable, revocable licence to install and use:
for both personal and commercial use, on devices you own or control, up to 2 Macs used by you (the licence holder).
A note on commercial use and watermarks. You’re welcome to use Nightjar and its map packs commercially. Maps, images, and other output you produce may carry a Nightjar watermark and the required open-data attributions (see section 9). You must not remove, hide, or alter that watermark or those attributions. Keeping them in place is a condition of your licence, including for commercial work.
The free or demo download may be used to try Nightjar before you buy, with reduced features, on the same basis.
You own this copy in the sense that it’s yours to use as described, but you do not own the software or the map packs themselves. All intellectual property in Nightjar, its design, and its code stays with Ranmont and our licensors (section 15).
The licence is generous for ordinary use, but there are limits. You may not:
Breaking these limits is a serious breach and may end your licence (section 14).
Map packs are downloadable files covering specific regions, bought one at a time. Once you’ve bought and downloaded a pack, it’s yours to use offline, indefinitely, under this licence. It doesn’t expire and doesn’t need to phone home.
Because delivery is a download, please keep your own copy safe. We’ll help you re-download a pack you’ve bought where we reasonably can, but we don’t guarantee to host every past pack forever.

Anything you create or import in Nightjar, such as your pins, notes, photos, videos, tracks, imported CSV/GPX/KML, and settings, is yours. Nightjar is offline and sends us nothing, so:

If you’re a consumer, the law gives you rights that these terms cannot take away or water down. In the UK, under the Consumer Rights Act 2015, digital content you buy must be:
If Nightjar or a map pack doesn’t meet these standards, you’re entitled to remedies such as a repair or replacement, and in some cases a price reduction or refund. See the Refund & Cancellation Policy.
If you’re in the EU/EEA, you have equivalent rights under your national law implementing EU consumer-protection rules (including the Digital Content Directive and the Consumer Rights Directive), and those apply to you too.
Nothing in these terms affects your statutory rights. Where anything below looks like it limits them, read it as limited only to the extent the law allows.
We build Nightjar carefully and want it to work well for you. We warrant that, when you use it as intended on a supported Mac, it will materially perform as described on our website and in the app at the time you bought it.
Beyond that, and beyond your statutory rights in section 11, Nightjar is provided “as is”. Because it works offline with large open datasets on hardware and configurations we can’t test exhaustively, we don’t promise that it will be error-free or uninterrupted, that every map detail is complete or accurate, or that it will fit a purpose you haven’t told us about. Please don’t rely on Nightjar as your sole tool for navigation or for any safety-critical, emergency, legal, or surveying purpose.
This section doesn’t cut down section 11 or anything else the law won’t let us exclude.
We’re responsible for loss you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill. We are not responsible for loss that isn’t foreseeable, or for loss caused by events outside our reasonable control.
We never limit or exclude, and nothing in these terms limits or excludes, our liability for:
Subject to that, and because Nightjar is a low-cost consumer product:
This is a fair allocation of risk for a one-time, low-cost purchase, and it doesn’t touch the protections the law reserves for you.
Nightjar, including its software, name, logo, design, and original content, is owned by Ranmont Ltd and, where relevant, our licensors, and is protected by intellectual-property law. The underlying map data is owned by the open-data projects and their contributors under the licences in section 9. These terms give you a licence to use Nightjar; they don’t transfer any ownership to you. Please don’t use our name or logo in a way that suggests we endorse you without our permission.
Our website and waitlist are there to tell you about Nightjar and let you register interest. When you use them:
You can leave the waitlist at any time using the unsubscribe link or by emailing us. We may change, suspend, or withdraw the website or waitlist at any time. Website content is provided for general information and comes with no warranty that it’s complete or error-free.
We’re not liable for failing to do, or being delayed in doing, something under these terms if it’s caused by an event outside our reasonable control (for example, outages at our hosting or Merchant-of-Record providers, or interruptions to the open-data sources we rely on). Your statutory rights are unaffected.
These terms and any dispute about them are governed by the law of England and Wales.
In short: we’ve chosen English law, but we’re not using it to strip away the local protections you’re entitled to.
Please talk to us first. Most things are quickest to sort out by email at support@nightjarmaps.com, and we’ll do our best to put things right. If your purchase was handled by our Merchant of Record, you can also raise payment or refund issues directly with Lemon Squeezy. If you’re an EU/EEA consumer, none of this affects your right to contact your national consumer-protection authority.
We may update these terms, for example to reflect a change of Merchant of Record, new features, or changes in the law. When we do, we’ll update the “Last updated” date at the top and publish the new version on this page. For changes that materially affect you, we’ll make reasonable efforts to flag them (for example, a notice on our website or, if you’re on the waitlist or have contacted us, by email).
The terms that apply to a purchase are the ones in force when you bought. Continuing to use Nightjar or our website after a change means you accept the updated terms for your ongoing use.
